    • The Game Time has come

I know it has never been the most consistently released series, but I am fairly certain the next Game Time (with Greg Miller) will be the final one. At least in its current incarnation. I love the sit down deep dives with really talented people, but I think there's a better format for it.

I really enjoyed the vlog with Barbara during the Always Open pilot episodes. I would love to make a (publicly available) spiritual successor to Game Time in that format.

      Thoughts?

EDIT: Used wrong version of "its"

On this week's podcast, I cut the label off my gatorade bottle and a lot of people asked me why. I wasn't really thinking about it. It most productions, you remove or alter the label on stuff that appears on camera, so I just have gotten in the habit of removing labels from most of my drinking bottles, even when not on camera. I don't have anything against Gatorade products in general.

    • Emojis

      burnie

burnie-32.png so as you can see we have new custom emojis for the site.

Now, many of you will no doubt ask "why did they bother to add Emoji's to the site rather than fix [insert a specific issue here] Which is clearly a much bigger problem?"

There are obviously a lot of things that we need to repair on the site and development is an ongoing process. A top priority was to get the video player up to par with players on other video – related sites.  Once that was completed, we had to make some fixes to bring the player up to the expectations of the members of the.  Rooster teeth site.

Beyond that, Emoji's were added because they were simple and they were fun.

As the new development team starts to make progress on the site it's important that they balance the technical progress with enjoyable progress as well.

Once the player fixes from the upgrade are complete we will be able to move on to some of the other issues that exist on the site.

    • Quiet Milestones

      burnie

Today's Game Time with Michael is the official wrap on the Lazer Team crowdfunding campaign obligations. We still have a couple of Shorts backers who are coming in town to shoot their cameos, but that's dependent on their travel.

It's a quiet milestone that I don't think many people will notice, but I am very proud to have completed it. The MDB campaign will wrap up even quicker -- in less than six months total. In fact, there's another card game that held a Kickstarter a few months before MDBgame and those cards don't start shipping until next month. #ButStuff

I wish it would go without saying that if someone has a successful campaign, they actually deliver what they said they would. Too often, that simply is not the case. I have about half a dozen open campaigns to which I have contributed over the years. I feel like I paid for monthly updates explaining why they can't manufacture the thing I actually backed. RT was able to deliver the movie AND release all the bonus stretch goals as well.

Thanks to everyone who contributed. You helped launch a next level franchise for RT. Would not have been possible without you.

Glad to see that so many of you are enjoying Crunch Time. Working with that cast and crew was an incredible experience. And I'm really proud of what our featured productions crew is doing these days. From Lazer Team to Crunch Time to Day 5, we learn more each time we make a new massive project. It's one of the main reasons I am excited to get started on LT2. The first production seems like a lifetime ago.

Figure here was as good as any. Thank you for talking about Uber. I am a driver for Uber and every time you all talk about it on the podcast it helps me with my service. Most of what you all talk about I don't do anyway, but it still helps. I've been a driver in Salt Lake City, UT for about 5 months and it's been great and horrendous at the same time. I have had 5 different rides puke inside of my car; 3 on the outside; I've broken 4 different fights in the car that got out of hand (couples fight in my car all the time); and I've even had someone try to jack my car as a rider. On the other hand, I usually have a bottle of water waiting in all of the doors for every rider. I keep my car ridiculously clean and as fresh smelling as I can make it. And I usually don't talk to the rider unless it seems like they want to talk, or they talk talk first. I do stand-up comedy, so sometimes I try some of my material just to get the rider laughing and having fun. Regardless, I still love driving for them. I'm sorry that you and others have had some pretty messed up experiences and hopefully it gets better. Maybe someday I can give you guys a ride when you or somebody comes down.

By the way, I've only listened to part of the RT Podcast as of right now. As a driver, we get a general phone number for every rider that forwards to your cell. We never have your real number. I would assume that you as a rider get the same for us. Didn't know if you guys found the answer, but there it is.

Worked night shift, two young girls sitting on a bench for 3 hours, so come around lunch I asked what was wrong, they needed a ride home. So I spent my lunch going across town with two 16 year old girls. I got a little scared when the cops called me asking me about the girls. I told them and I gave them a ride home and showed them the place I dropped them off. Turns out their parents drop them off got drunk and forgot about them. Even though doing a good deal, I was still scared since I was a 22 year old guy.

Yesterday I was on my way to work and I stopped off at the gas station to get some gum. As I was walking in, I held the door open for the guy behind me. After looking at gum for about 30 seconds he came up to me and asked for money. He told me the only reason he came up to me was because I held the door open for him and I seemed like a nice guy. I gave him a dollar and told him it was all the cash I had. He kept telling me to go to the ATM to get more money out to give to him.

It reminded me of the story you told on the podcast about helping those guys push their car. You're right about what you said. No good deed, no matter how small, goes unpunished.

      Mr. Burns,

I know you have a very busy schedule, so I'll try to keep this as brief as I can.

I was watching podcast #333, and heard of the story about the two men who rudely unappreciated the help you gave them on the road. The very next day, I was delivering a four inch wide and twenty-foot long piece of cast iron pipe, which I can assure you is rather heavy. A man in a truck drove up and offered to help, which I gladly accepted. After setting the piece where it was needed, I made sure to shake the man's hand and thanked him again for his help. I've always tried to thank one for going out of their way to help whenever I'm in a pickle, but at that point I was thinking, "I kinda wished Burnie was here right now."

Hope your week is treating you and the RT crew well.

      Burnie, or Mr. Burns,
Listening to RT Podcast #329 I'd like to say that as a sponsor I appreciate all that you do for us. I am not among the group that thinks you don't do enough for sponsors. In fact given my limited time around work I can't keep up with all the videos and etc I have access to!

I understand that dealing with the people who want something for nothing and that speak out of turn when they just want to be that complaining internet voice*in greatest internet voice impersonation* "gosh, why don't you do more for sponsors? geez it's like you don't care..." is part of the job, but in the end it's not fair to you guys who work so hard to make us happy. Don't Listen to them sir. You guys are so awesome and those of us who can understand what's what appreciate all that you do.

Burnie, as a sponsor I prefer to watch all RT videos through the site. However, I find that I watch more videos on YouTube because it has the "watch later" function. It helps to manage what videos I've seen and which I have not. I almost feel guilty for not watching the videos on the RT site because the RT business model is so oriented around the site. Would it be possible to implement a playlist feature to the new site to make viewing the content easier?

Hey Burnie, I'm pretty certain you get quite the volume of messages so heres to hoping this gets through, but I have a game suggestion! I'm probably going to mention to add it to the patch game club but I know I'd like you specifically to try it if you haven't already. The game is called Antichamber and it's akin to portal as a great puzzler however it's a game that just makes you happy to play it with a relaxing tone and great philosophy. It's on steam for I believe 20$, oh and if you choose to look more up about it i advise NOT looking at any videos and just reviews because the puzzles twist reality and how you expect things to work so the videos may give some of it away. Well hope I get through to you and hope if you do try it out, you enjoy it. Antichamber is quite the experience ^^. Thanks again for all that you do -Nerv

I didn't realize how much I wanted a remastered Fallout 3/New Vegas until you mentioned it on twitter. What would be even better would be a remaster of the original two turn based Fallout for consoles. I was never able to get into the games because I had played Fallout 3 first and that was my first experience with the franchise. I'm stoked to see Fallout 4 coming but I think that remaster of the original two for consoles would be amazing and I would throw even more money at Bethesda.

Supreme Court Opinion Makes Prosecution of Internet Trolls More Difficult

*Disclaimer – I am not licensed to practice law. The following is a reflection of my reading of a Supreme Court opinion, and should not be relied on by anyone. I am not advertising my services, seeking compensation, or looking for notoriety: I am offering an explanation of the significant legal principles as I seem them for informative purposes.*

Today the Supreme Court ruled in Elonis v. United States that a law often used to prosecute internet users who make threatening comments over the Internet could not be used unless the perpetrator knew the language to be threatening. Prior to this ruling, most courts held that an internet threat is illegal if a reasonable person (e.g. the person being threatened, other site-users) would feel threatened. The court today, however, found this rule was not an accurate interpretation of the statute, and required that any person convicted of making internet threats must be “blameworthy in mind before he can be found guilty.†While this ruling is a win for internet users who say the threats they make over the internet are intended for therapeutic or cathartic reasons, I am concerned that Internet threats are often made in passing while read quite seriously, making prosecution difficult under any other interpretation. This ruling requires authorities to demonstrate that a threat was made to be taken seriously, or at least made with the awareness that it might be taken seriously—a more difficult standard to prove unless the defendant admits what he or she was thinking when the threat was made.

The facts of the case are that Anthony Elonis was arrested for 5 counts of violating 18 USC §875(c) which makes it a crime to transmit “any communication containing any threat to injure the person of another.†The statute was enacted in 1939 to apply to telecommunications that existed at the time, but is still used for federal prosecutions regarding threats made over the internet. Elonis made threats towards his coworkers, resulting in his termination from the amusement park where he worked. He also made threats against his wife, saying “Fold up your [Restraining Order] and put it in your pocket/ Is it thick enough to stop a bullet?†and providing details to the public on his Facebook page detailing what he believed to be the most effective way to fire mortar rounds at his wife’s home and not get caught. He made threats against Police; as well as an FBI agent that visited his house about the threats, posting to his Facebook after the incident “So the next time you knock, you best be serving a warrant/ And bring yo’ SWAT and an explosives expert while you’re at it/ Cause little did y’all know, I was strapped wit’ a bomb/Why do you think it took me so long to get dressed with no shoes on?/ I was jus’ waitin’ for y’all to handcuff me and pat me down/ Touch the detonator in my pocket and we’re all goin’.…†Finally, Elonis commented on another Facebook user’s post, “That’s it, I’ve had about enough/ I’m checking out and making a name for myself/ Enough elementary schools in a ten mile radius to initiate the most heinous school shooting ever imagined/ And hell hath no fury like a crazy man in a Kindergarten class/ The only question is… which one?â€

At trial, the jury was instructed that Elonis was guilty of breaking the law if a reasonable person would have understood that the posts he was making were real threats, which are not protected by the First Amendment to the Constitution. Elonis argued that the word “threat†indicates that he must purposefully or knowingly make the threat to cause someone to feel threatened; a fact which was not determined at trial and which Elonis argues he did not intend. The government argued that Elonis’s purpose in making the argument did not matter because the statute does not require “an intent to threaten†only that the communication includes a threat. The trial judge agreed with the government’s argument, thus instructing the jury that Elonis was guilty if a reasonable person would have understood his words as threats. The Supreme Court overruled this jury instruction, sending the case back to a lower court to determine if Elonis was guilty based on some other interpretation of the statute.

The lower court now must consider whether to adopt Elonis’s interpretation of the statute and require that internet threats be made with the purpose or knowledge of being threats in order to be illegal. If this interpretation is adopted, Elonis is less likely to be convicted because the jury is more likely to take him at his word that he did not intend—and did not know—that anyone would take his posts seriously. The Court could also choose a middle ground between Elonis’s and the Government’s argument by applying the standard of recklessness. Elonis recklessly threatened his victims if: 1) He had a substantial awareness that his words might be taken as threats; and, 2) A reasonable person would have understood that Elonis’s words were threats.
